FEDERAL GARNISHMENT EXEMPTIONS
Federal Law exempts from garnishment 75% of disposable earnings per week, or an amount to 30 x federal minimum hourly wage, whichever is greater. Some states laws still on the books are listed below, but where federal law provides larger exemption, it supersedes the state law.
*Denotes states having community property laws. West Virginia and Kansas have "Equitable Distribution" Law with regard to marriage. Alaska married couples may elect to treat their assets as being owned by the marital community. Missouri is a common-law state, however, it recognizes "Tenancy by the Entireties". Montana has "Equitable Apportionment".
